GENERAL CONDITIONS FOR USE OF THIS WEBSITE.
In the context of this website, “we”, “our” and “us” means terramerino.com.au / TERRA / Terramerio Pty. Ltd. and “you” and “your” means you, the user or customer of this website.
The use of the term “product” includes the plural “products”.
Except if otherwise required by law the following Terms and Conditions, the Contract of Sale and our Privacy Statement govern your use of this website. They describe the rights and responsibilities of both you and us. If you use this website you agree to be bound by the Terms and Conditions and if you shop at this web site you agree to the terms of the Contract of Sale.
If you do not agree to the Terms and Conditions and the Contract of Sale and our Privacy Statement do not use this website.
We shall not be responsible for any detriment incurred by reliance you place on this website or its contents. Use of this website is on an “as is” basis and is entirely at your risk.
CHANGES TO TERMS
Because of frequent changes in Internet technology and applicable law we reserve the right to make changes to these Terms and Conditions at any time that technology and legal changes require. You should check these Terms and Conditions regularly for such changes.
The information on this site is intended and applicable for Australian consumers only and is governed by Australian law.
It is your responsibility to provide your correct email address, delivery address, billing address and telephone number. Incorrect personal, billing and delivery addresses may lead to a delay in the delivery of the products to which TERRA takes no responsibility.
Your personal details that you provide to place an order are placed on a secure server. Secure Sockets Layer (SSL) encrypts the information you send through this website. We make no warranty in respect of the quality of that encryption and accept no responsibility for events arising from unauthorised access of the information you provide.
CONTRACT OF SALE
These terms together with your order constitute the entire contract between you and us for the supply of products. No other terms will apply except where terms may be implied by law. The contract cannot be varied unless we agree to vary it in writing or by email.
You can place an order only by clicking the “Add to Cart” button.
When you place an order with us you have made an offer to purchase the product you have chosen and when we issue a tax invoice or customer receipt to you we have accepted your offer. Both offer and acceptance are based on these terms and conditions.
We will issue you with an Order Number by email after we have received your offer to purchase.
We will notify you when we process your order by sending you an Order Confirmation and tax invoice via email (or included with your item ). In order to prevent credit card or payment fraud your offer can only be accepted by us after it has passed our validation procedures.
We accept payment through Australian Cheque (made out to Terra Merino Pty Ltd and marked “NOT NEGOTIABLE”, Australian Money Order (made out to Terra Merino Pty Ltd, Electronic Funds Transfer, BPAY, PayPal and Credit cards (Visa and Master).
Purchased items will be dispached from our store upon full payment to our Banking facility. If payment is made by Cheque, items shall be dispatched on clearance of the cheque by our Bank. If an item purchased cannot be supplied TERRA shall contact you to offer a suitable replacement, cancel the order or issue a refund of your total payment recieved at our Bank.
You must retain your tax invoice / customer receipt as proof of purchase.
CREDIT CARD PAYMENTS
We reserve the right to reject International Credit Card payments if our Bank is unable to process said payment.
We begin to process Credit Cards payments at the completion of the checkout screen.
Whilst we employ the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, we will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
You will be provided with an estimated delivery time when you checkout from placing your order. The estimated delivery times are in working days Monday to Friday excluding public holidays. Normal delivery is within 1 to 5 working days from the date of receipt of full payment for your order. Terra uses Australia Post as it’s delivery provider, Terra does not and can not guarantee estimated delivery times claimed by Australia Post. Refer to Australia Post’s website for their stated delivery times.
We will make every effort to deliver your product within the estimated delivery time but the actual delivery times may change due to changes in supply or circumstances beyond our control.
If your product has not arrived within the estimated delivery time, please contact us.
DEAD ON ARRIVAL POLICY
TERRA has a “Dead on Arrival” policy. This means that if the product is damaged during delivery and a written claim is made within 2 days from the date of receipt and returned in original packaging within 7 days from claim date, then TERRA will replace the product at our discretion and our cost. If the damaged item is “out of stock” or a “discontinued line” TERRA will contact you to arrange for a similiar product or offer a full refund.
This warranty does not apply to damage packaging.
Many of the products supplied by TERRA are covered by a Manufacturers voluntary warranty. The terms and conditions of such warranties are beyond our control and it is your choice whether to use such warranties.
A manufacturers warranty does not detract from your statutory rights.
Terra passes on to you the manufacturer’s warranty and applies the Conditions and Warranties required by law.

Should you wish to claim a refund, please contact TERRA by email firstname.lastname@example.org stating your contact details, order number and reason for return. Where a warranty / refund claim is agreed to, any refund will include a one way delivery cost costs for the product. TERRA will refund or replace the item or items when we have received the product from you within 7 days of claim date. Refunds will be issued by EFT, PayPal or refund to your credit card consistant with your original payment method. Please note that Pay Pay takes a small processing fee upon issue of a Pay Pal refund.
TERRA will not provide a refund, credit or exchange if you have:
- damaged the product by using it in a way it was not meant to be used.
- changed your mind and decided you no longer want the product,
- found you can buy the same elsewhere for an equal or cheaper price,
*did not securley wrap and protect the product or place it in unsatisfactory packaging for posting (please refer to Australia Post regarding proper packaging for posting)
Where a replacement is agreed to the replacement will be delivered to you at our expense after we have received your returned product complete including all packaging (in reasonable condition) and all accessories included with the item.
Returned items shal be returned to TERRA via Australia Post or a regitererd courier service within 7 days of claim date. Every effort shall be made ensure the returned item is repackaged in a way as to prevent further damage to the product.
RESOLVING YOUR CONCERNS
We request that you contact TERRA in the first instance to resolve any issue before persuing alternate means of resolution.
